Just wondering: was it a clean install in Joomla3 or was it an upgrade from Joomla2.5 -> joomla 3?

@jojo12: thx! it was the media/com_jem/css/jem.css file, which only had read permission set. Though I didn't change it, I might had a look at it during installation & configuration of JEM, but I never changed permissions.
I was still able to do changes to it in backend of JEM, but this didn't change the permissions, so I now assigned the write permission for the owner via ftp. This solved my error and I could update to 2.1.2.
@Bluefox: yes, in my case it was an upgrade from Joomla 2.5. You think this could be the reason for it?

Hi Rickard,
as far as I understood the problem here was caused by insufficient file permissions which prevented Joomla installer from copying some files on file system.
